MP RERA Delay Interest — How It Works
Madhya Pradesh RERA oversees real estate projects across Bhopal, Indore, Jabalpur, Gwalior, and the rest of the state. Under MP RERA's framework, delay interest is calculated as simple interest at SBI MCLR (1-year) + 2% per annum, running from the committed possession date in the registered Agreement for Sale. Complaints can be filed online at rera.mp.gov.in with a filing fee of ₹5,000. The Madhya Pradesh RERA Authority has been increasingly active in enforcing builder compliance, particularly in the rapidly growing Indore and Bhopal markets where project delays have been common. The Authority strictly considers the date mentioned in the registered Agreement for Sale as the binding possession date. Under Section 18 of the RERA Act, 2016, supported by the Supreme Court's ruling in Newtech Promoters vs State of UP (2021) affirming the statutory rights of allottees in delayed projects, buyers are entitled to statutory remedies including delay interest or refund. Non-compliance with Authority orders attracts a daily penalty cumulatively extending up to 5% of estimated project cost under Section 63, and continued defiance of Appellate Tribunal orders can result in imprisonment up to 3 years and/or a fine cumulatively up to 10% under Section 64.
